About the role
Description
The Commercial Contract Manager provides commercial and contract management consulting services to Burns & McDonnell’s project and program clients, and supports Burns & McDonnell global practice business line managers and project managers with commercial and contract matters on an as-needed basis. This position is a strategic, client-facing role, which also involves interfacing with legal, risk, insurance and other corporate teams for guidance as appropriate.
Job Functions (Essential Functions)
- Provides consulting services to Burns & McDonnell clients in the areas of commercial and contract management. This may involve:
- Providing insight on procurement strategies, project delivery models, and associated commercial frameworks.
- Providing insight on contract forms and commercial requirements.
- Supporting the development of project procedures, processes, guidelines, and checklists for commercial and contract management functions.
- Supporting preparation of RFP packages and evaluation matrices.
- Participating in the review and evaluation of contractor proposals.
- Participating in the review and validation of contractor payment applications.
- Developing claims avoidance and mitigation strategies and plans.
- Participating in the review and response to contractor change order requests and claims.
- Supporting review of contractor deliverables against contract requirements.
- Participating in monitoring contractor performance against contract requirements, including flagging issues to the project team and drafting notices/letters to the contractor for client approval.
- Assisting the project team as needed by providing a contract/commercial focus in other activities such as project planning, estimating, risk management, and scheduling.
- Supports internal teams with the commercial and contract management functions. This may involve:
- Reviewing contractual terms of various commercial agreements and supporting the preparation of the necessary deviations in accordance with internal processes and project managers
- Participating in contractual risk assessments in order to obtain internal approvals before concluding contracts.
- Participating in client contract negotiations in accordance with strategies defined with project managers.
- Supporting the development and implementation of risk mitigation strategies for business line teams and project managers.
- Support the growth and development of commercial competencies within Burns & McDonnell. This may involve:
- Supervising the work of assigned commercial and contract personnel on projects.
- Coaching and mentoring personnel to enhance their commercial skillsets.
- Developing and delivering training programs for Burns & McDonnell personnel on commercial and contract topics.
- Developing procedures, processes, guidelines, checklists and other tools to support internal commercial and contract management functions.
- Performs other duties as assigned.
- Complies with all policies and standards.
Qualifications
- Bachelor Degree in Business, Supply Management, Law, Construction or related field. and 7 years experience supporting attorneys or executives, or complex procurement, preferably in the architecture/engineering consulting or construction industries, or the legal field required.
- Must have strong knowledge of commonly used legal processes, practices and procedures.
- Requires previous experience working with corporate legal matters, including keeping records, and corporate registrations, licensing and other filings.
- Must be able to manage and complete multiple tasks in a timely manner, meeting applicable deadlines.
- Requires strong analytical ability, critical thinking, problem solving and research skills.
- Must be a self-starter who can work independently with minimal guidance.
- Must be detail oriented and have strong organization skills.
- Requires excellent interpersonal skills, including the ability to work effectively with all levels of management, clients, in-house attorneys, outside counsel and others outside of the organization, and the ability to maintain a positive, friendly and outgoing attitude.
- Requires superior verbal and written communication skills, including strong editing and proofreading skills.
- Must have advanced skills in all Microsoft Office applications.
- Must be responsible in dealing with sensitive information, always keeping confidential and proprietary information safe and secure.
